2025 Vote on Governing Documents

The following was mailed to Sunny Hill HOA members postmarked October 9, 2025:

Upcoming Vote on Modernization of the Sunny Hill HOA “Declaration” Document

As we discussed at the annual meeting last March, we have prepared amendments to our existing “Declaration” document, and the time has come to put this document to a vote.  The proposed document does NOT add any new restrictions, does NOT authorize fines, and primarily provides modernization, clarification and a few important legal provisions. A redline copy of this document can be found on our website under “Documents.”

As a separate effort, early in 2026, we will conduct extensive polling to determine if the neighborhood is generally in favor of any new restrictions or other substantive changes. Polling results will be discussed at the 2026 annual meeting. Any new restrictions or substantive changes that have widespread support will be voted on individually later in 2026.

We are required by law to provide this notice at least 10 days prior to mailing out the ballots for the vote. The voting timeline is as follows:

• October 9, 2025 – Notice of upcoming vote mailed.
• October 22, 2025 – Ballots mailed.  Please vote promptly!
• November 15, 2025 – Voting period ends. For passage, a majority is required (52 “yes” votes).

The Board has the right to extend the voting period if necessary and will provide additional written notice if this is needed.

Your votes are confidential, and the Board will not share how individual homeowners vote. Nonetheless, all homeowners have the right to petition the Board for secrecy procedures. Such petitions must be received, in writing at our P.O. Box address (see reverse page for address), at least three days before ballots are mailed on October 22^nd. If a sufficient number of petitions for secrecy procedures are received, the entire vote will be conducted with secrecy procedures (this will not be done on an individual basis).
